Biography
Mr. Bonifield has represented a wide variety of clients in patent litigation matters as well as providing opinions on patent infringement and validity.
In patent litigation, Mr. Bonifield, who has a degree in biology, has represented clients in a variety of scientific fields including pharmaceuticals, medical devices, molecular biology, biotechnology, electrical, mechanical and chemical engineering, organic chemistry, and agroscience. He has participated in trials in the United States District Courts for the Northern District of Illinois, the District of Delaware, the District of Oregon, the Southern District of Florida, the Southern District of New York and the Eastern District of Pennsylvania. He has also worked on multiple appeals before the United States Court of Appeals for the Federal Circuit.
Notable Representations
Representing Johnson & Johnson in a broad range of patent litigation matters involving pharmaceuticals, biotechnology, consumer products and medical devices. Mr. Bonifield assisted in the representation of Johnson & Johnson at several trials, and on appeal before the Federal Circuit.
Representing The Dow Chemical Company in a patent litigation in the District of Delaware against NOVA Chemicals Corporation relating to Dow patents on specialty polyethylene products.
Representing Dow AgroSciences in patent litigation involving new vegetable oils. Mr. Bonifield represented the client at every phase of the litigation, including discovery, claim construction and summary judgment, at trial and on appeal. Mr. Bonifield and the team successfully obtained a summary judgment ruling that invalidating two allegedly blocking patents, and a post-trial ruling holding that the other two allegedly blocking patents were unenforceable as a result of inequitable conduct. Mr. Bonifield assisted on appeal, where both rulings were upheld.
Representing Merck & Co., Inc. in pharmaceutical litigation in the District of Delaware against generic manufacturer Ranbaxy relating to a Merck antibiotic.
Representing Pechiney Plastic Packaging in patent litigation involving the mechanics of manufacturing plastic packaging for meat products. Mr. Bonifield represented the client at trial and helped successfully defend the client against a competitor’s claim of tortuous interference with contract. |
