Biography

 

Gary's practice includes complex commercial litigation. He specializes in the representation of many entertainment industry clients in litigation involving motion picture financing, production and distribution, copyright, trade secrets and unfair competition. He has extensive experience in jury and non-jury trials, appeals in state and federal courts and in arbitrations in the U.S. and the U.K.

Notable Representations

 

Successfully represented a leading motion picture bond company in a series of arbitrations and lawsuits involving fraud and breach of contract claims with respect to the budgets of a slate of motion pictures.


Successfully represented a major motion picture producer in a jury trial against a leading bank concerning the financing of a slate of motion pictures.


Successfully represented a European motion picture distributor in an arbitration concerning distribution rights to two major motion pictures.


Successfully represented a U.K. motion picture bond company in an arbitration in London concerning the financing and distribution of a motion picture.


Successfully represented a financier of a motion picture in a series of lawsuits against a major actress over the performance of an acting agreement.


Successfully represented an Irish director and producer in an arbitration concerning the financing and credits for a motion picture.


Successfully represented a Canadian motion picture bond company in a series of arbitrations concerning the financing and delivery of motion pictures.


Successfully represented a television production company in obtaining summary judgment in copyright action and in appeal of judgment. Brewer-Giorgio v. Producers Video, 216 F. 3d 1281 (11th Cir. 2000).


Acted as lead counsel to 33 local governmental entities in the action entitled People of the State of California ex. rel Stull v. Bank of America, N.T. & S.A., et al., a public finance action brought under the California False Claims Act and was appointed to the Plaintiff’s Executive Committee established to coordinate the litigation of the case, which involved hundreds of public entity plaintiffs. Recovered nearly $200 million in settlements.
