Biography

 

Before joining the firm in 2000, Harry A. Olivar, Jr. was a litigator in the New York and Los Angeles offices of Sullivan & Cromwell and the Los Angeles office of Dewey Ballantine.  Mr. Olivar’s practice focuses on securities and accounting fraud actions, class actions and other complex commercial litigation in both state and federal court.

Notable Representations

 

Obtained dismissal of both federal securities fraud claims and a state-court action seeking in excess of $2 billion from an outside director of a software company.

 

Obtained over $150 million in settlements for plaintiff on fraud and fraudulent transfer claims arising from an insurance acquisition.

 

Obtained two seven-figure settlements for three Section 11 plaintiffs who had purchased preferred stock under a flawed prospectus.

 

Obtained summary judgment on antitrust and fraud claims brought against a major lawn and garden manufacturer, and affirmances in both the Sixth and Ninth Circuits.

 

Obtained a jury verdict for plaintiff, including a punitive damages award, in a tortious interference action in the District of Columbia.

 

Obtained a defense verdict after a three-week trial in a fraudulent conveyance action brought by institutional lenders to two $100 million solar power partnerships.

 

Obtained an arbitration award finding no liability for a Canadian brokerage firm, including affirmance by the Ninth Circuit on appeal, in a dispute involving unsuitability and fraud claims.


 
Obtained dismissal of claims filed by the Milberg Weiss firm challenging a tender offer under the “all holders, best price rule.”

 

Defeated a motion for class certification and obtained summary judgment on behalf of a financial institution in a securities fraud case involving trust deed investments in excess of $100 million.

 

Represented motion picture studio during a highly publicized three-month trial of a $580 million claim brought by a former executive.
