Biography

 

Sean Pak is a partner with Quinn Emanuel's San Francisco office. He is a patent litigator with extensive experience in litigating, licensing and acquiring patents and other intellectual property across a wide range of hardware and software technologies. In the 2008 Legal 500 US guide, Mr. Pak was recognized for his US patent litigation work. Also in 2008, The Times of London named Mr. Pak a "Future Star of America" and cited his "intellectual prowess, industry expertise and people skills."

Notable Representations

 

Represented plaintiff Veritas Operating Corp. (a wholly owned subsidiary of Symantec) against Microsoft in a multi-faceted case involving claims of trade secret misappropriation, patent infringement, copyright infringement, and contract breach in the field of volume management software, storage array network and automated system recovery technologies in US District Court for the Western District of Washington. Summary judgment of invalidity and non-infringement of Microsoft patent granted.


Represented defendant Lucent in a patent case brought by plaintiff Golden Bridge Technology in US District Court for the Eastern District of Texas (Marshall) involving a patent claim against power ramping techniques for establishing a random access channel in a 3G wireless network. Summary judgment of invalidity for all asserted claims granted, which was upheld by the Federal Circuit on appeal.


Currently representing defendant Oracle in a patent infringement case brought by plaintiff Aloft Media in US District Court for the Eastern District of Texas (Tyler) involving patents related to collaborative decision software.


Currently representing defendant Oracle in a patent infringement case brought by plaintiff Implicit Networks in US District Court for the Western District of Washington (Seattle) involving patents related to client-server software for applets.


Represented defendant Oracle in a patent case brought by plaintiff Sky in US District Court for the Eastern District of Texas (Marshall) involving patents related to automated negotiations software.

Represented defendant Lucent in a patent case brought by plaintiff Telcordia in US District Court for the District of Delaware involving several patents related to dynamic time division multiplexing, survivable ring network and clock recovery technologies. Also represented Lucent against Telcordia  in  a related International Trade Commission investigation.


Represented defendant Lucent in a patent case brought by plaintiff QPSX in US District Court for the Eastern District of Texas (Marshall) involving a patent covering packet discarding techniques for ATM networks.


Represented defendant Broadcom in two related patent cases brought by plaintiff Wi-LAN in US District Court for the Eastern District of Texas (Marshall) involving patents related to wireless and ADSL technologies.


Represented Broadcom in a heavily litigated case involving the assertion of eleven patents owned by STMicroelectronics and Broadcom against each other in the US District Court for the Eastern District of Texas (Sherman). Patents covered a wide range of technology areas including wireless communications, dual port memory, electrostatic discharge protection, power management and semiconductor manufacturing process.


Represented defendant Broadcom in a patent case filed by Lonestar Inventions against Broadcom and other defendants in the US District Court for the Western District of Texas (Austin) involving a patent on interdigitated capacitor structures.


Represented respondent Monolithic Power Systems in a patent investigation before the International Trade Commission instigated by complainant Linear involving two patents in the area of switching voltage regulators.


Represented defendant Monolithic Power Systems in a patent case brought by plaintiff Microsemi in US District Court for the Central District of California involving four patents related to ballast circuitry for cold-cathode fluorescent lamps used in LCDs and other display devices.


Represented Veritas (now Symantec) in a patent infringement litigation brought by Raytheon against Veritas and other vendors of data backup software and equipment in the US District Court for the Eastern District of Texas (Marshall).


Represented defendant Zhone Technologies in a patent case brought by plaintiff QPSX in US District Court for the Eastern District of Texas (Marshall) involving a patent covering packet discarding techniques for ATM networks.


Represented Rockwell Collins in a trade secret action brought by Thales against Rockwell Collins in the US District Court for the Central District of California involving in-flight entertainment and media server systems. Rockwell Collins counterclaimed for patent infringement against Thales.


Represented Conexant in a patent infringement litigation brought by ETTP against Conexant and other modem manufacturers and PC OEMs in the US District Court for the Eastern District of Texas.


Represented Lexar in a multi-patent infringement action brought by Lexar against multiple defendants in the US District Court for the Northern District of California involving flash memory design and control circuitry.

Represented MediaTek, a Taiwanese corporation, on intellectual property transactions and disputes involving GPS, WiMax, optical disk drive, digital TV and manufacturing process technologies.


Represented Chevron on intellectual property transactions and disputes involving clean tech and advanced battery technologies.


Represented Symantec on a variety of intellectual property matters involving volume management, clustering, file system, anti-virus detection and malware prevention technologies.


Represented Disney on joint patent ownership and other intellectual property issues in connection with Disney's participation in various standard-setting organizations related to multimedia and data security.


Represented Adobe in connection with intellectual property licenses offered by third parties with respect to various Adobe products. Also, represented Adobe in localizing various license agreements and marketing programs for the Korean market.


Represented Samyang, a Korean corporation, on intellectual property matters in connection with its US joint venture with Nanoptics in the area of plastic optical fibers for digital communications.


Represented Maxxan in the negotiation of a licensing agreement with Phoenix Technologies involving storage area network (SAN) technology. Also, represented Maxxan regarding various license and distribution agreements.


Represented Silicon Graphics in evaluating patent portfolios for potential acquisition, licensing and enforcement in the area of high-performance computer systems and networking.
