Biography

 

Edith Ramirez handles a broad range of complex business litigation matters, including successfully representing clients in actions involving copyright and trademark infringement, antitrust and unfair competition claims.  In the field of Spanish-language music and entertainment, Ms. Ramirez has counseled and represented Latin promotion and production companies in a variety of litigation matters.  Ms. Ramirez also has extensive appellate litigation experience.




Representative Clients

 

In intellectual property matters, Ms. Ramirez has represented Mattel, American Broadcasting Companies, The Walt Disney Company, Izumi Products, and Seiko Epson Corporation.

 

In the field of Latin media and entertainment, she has represented Hauser-CIE Entertainment, Univision, and Ventura Productions.

 

She has also represented The Scotts Company, Northrop Grumman, and Hathaway Dinwiddie Construction.




Notable Representations

 

Represented a major Latin music promotion and production firm, Hauser-CIE Entertainment, against an internationally acclaimed Mexican singer for the breach of an exclusive promotion contract.  Obtained a $2 million award and permanent injunction against the singer.

 

Representing American Broadcasting Companies, prevented a foreign plaintiff from proceeding with a copyright infringement action in California involving the quiz show "Who Wants To Be A Millionaire."

 

Represented Scotts Lawn and Garden when a former distributor alleged breach of contract and fraud.  Defeated the $900 million breach of contract and fraud counterclaims before trial and then went on to recover over $10 million at trial on the manufacturer's contract claims to recover millions of dollars owed by the former distributor. 

 

Represented Scotts Lawn and Garden in an antitrust jury trial in the Southern District of New York.  Plaintiff alleged an unlawful agreement in restraint of trade and conspiracy to monopolize the consumer market for herbicides and sought $250 million in damages.  Obtained a complete defense verdict after four weeks of trial.


Representing Mattel, obtained a $500,000 sanctions award against our opponent's counsel pursuant to Federal Rule of Civil Procedure 11 for the filing of a frivolous copyright infringement action.

 

Representing Hathaway Dinwiddie Construction, obtained a reversal by the Ninth Circuit of a grant of summary judgment against our client on breach of contract and other claims.  Persuaded the Ninth Circuit that the district court had erred by resolving contested contract formation and interpretation issues as a matter of law.  The Ninth Circuit affirmed summary judgment in the client's favor on related contract counterclaims.
