Biography

 

Chip Rawlings joined Quinn Emanuel in June 2002 as a partner.  Before joining Quinn Emanuel, he was a litigation partner at the international firm Morrison & Foerster, at Belin Rawlings & Badal (a trial practice firm he founded with Daniel N. Belin), and at the national firm, McKenna Conner & Cuneo.


Chip has substantial trial and alternative dispute resolution experience.  His practice has focused on major complex disputes and legal problems, including trial practice and all forms of alternative dispute resolution, including arbitration and mediation. He has represented and advised major U.S. and foreign companies and individuals in a variety of trials, arbitrations and mediations/settlements, including  securities, derivative actions, class actions, financial services, construction, unfair competition, contract, RICO, insurance coverage, products liability, defamation, personal injury, real estate, trust disputes and other complex commercial cases.


Chip has considerable experience litigating class action cases.  He has represented real estate developers, financial institutions and broker/dealers in numerous class actions.   He has defended real estate developers, financial institutions of all kinds, broker/dealers, and other entities against claims for breach of contract, specific performance, breach of warranty, fraud and misrepresentation, and alleged non-compliance with various local, state, and federal laws and regulations.  The class actions in which he has been involved have included claims ranging from $5 million to $700 million in dispute.


Chip also has extensive experience litigating securities cases.  He has been involved in numerous large securities actions, many of which have involved disputes arising from the transactions involving highly complex derivative securities, including actions by non-profit and "for profit" entities to recover losses caused by investments in derivative and other complex securities instruments.

Representation of individual and corporate investors in the prosecution of and defense against lawsuits arising out of efforts to obtain or maintain corporate control through stock purchases, shareholder derivative actions, tender offers and other securities actions, and in some cases the prosecution of or defense against related RICO claims.


Representation of individuals, partnerships, corporations, and corporate officers and directors in connection with various enforcement proceedings and investigations by the SEC and state regulatory authorities.


Representation of broker/dealer in recovery action against agent and partner for recovery of embezzled funds, while providing advice in connection with actions to take to successfully avoid adverse regulatory action.


Representation of buyers and sellers of real property in various lawsuits involving the enforcement of covenants contained in purchase agreements, the rescission of purchase transactions on the basis of fraud and concealment, and other causes of action giving rise to claims for compensatory and punitive damages.


Representation of a number of real estate developers in the defense against claims brought by real estate purchasers for breach of contract, strict liability, specific performance, breach of express and implied warranty, fraud and misrepresentation and alleged non-compliance with various local, state and federal land use and environmental laws and regulations, and in the pursuit of cross-claims for recovery from contractors and sub-contractors with regard to the developments.


Representation of various parties in litigation presenting issues regarding eminent domain, inverse condemnation, prescriptive easement, landslide, slippage and subsidence problems and construction defects (including personal injury claims allegedly arising from construction defects which purportedly led to mold infestation).


Representation of financial institutions in the defense against a number of class action lawsuits challenging the enforceability of mortgage loan contracts, and seeking compensatory damages and restitution, which in individual lawsuits ranged from more than $10 million to more than $500 million, on the basis of claimed breaches of contract, fraud and misrepresentation, violation of statutory obligations, unenforceability of contracts of adhesion and penalty clauses, overcharges of interest and other fees, 360-day/year interest claims, usury, racial discrimination/redlining, and anti-trust violations.


Representation of financial institutions in cases brought primarily under §17200 alleging predatory lending practices and actions by purchases of loans allegedly constituting aiding and abetting of predatory lending practices.


Representation of real estate developers in over 20 class actions involving construction defect claims.


Representation of a financial institution in the defense against claims of an alleged price fixing conspiracy between that financial institution and other financial institutions in California, with respect to allegations concerning parallel pricing of fees and rates for loans.


Representation of a corporate partner to a software development joint venture for the purpose of protecting the intellectual property of the venture from disclosure to, and use by, a competing corporation.


Representation of manufacturer, computer company, and financial institutions in prosecution and defense of claims of trademark, trade name, trade dress and patent infringement, and related claims of unfair competition.


Representation of computer services company in computer cases where the plaintiffs alleged defects in the manufacture of hardware or software which caused damages to the ongoing operation of the plaintiffs' businesses.
