Mr. Selendy's main practice area is complex civil litigation and arbitration, with emphasis on securities, antitrust, structured products, fraud, and insurance, as well as class actions.

Notable Representations

 

Represented limited partners of an investment partnership in a derivative action against a general partner based on claims of systemic fraud through post-execution allocations of securities trades in an arbitration resulting in over $75 million in compensatory and punitive damages, including disgorgement of $35 million in compensation over the period of the fraud.

 

Asserted novel federal securities fraud claims on behalf of Carl Icahn arising from market manipulation by Perry Capital in connection with vote-buying through hedged transactions to affect a proposed merger between Mylan Corporation and King Pharmaceuticals.

 

Represented YES Network in obtaining favorable arbitration outcome respecting terms of carriage on Cablevision Systems after initiating antitrust proceedings that compelled Cablevision to arbitrate.

 

Represented Zurich Centre in appeal that resulted in successful settlement after Texas bankruptcy court holding that a surety bond made Zurich a de facto general partner in bankrupt nursing home operation with several hundred million of liabilities.

 

Developed forced-sale securities fraud class action against Genzyme Corporation based upon market manipulation in connection with the redemption of common tracking stock.

 

Litigated ERISA class action against pharmacy benefits manager Medco to a $42.5 million settlement.

 

Represented Andersen in successful auditor independence rule-making proceedings before the SEC.

 

Obtained trial court victory for the NRDC against Mallinckrodt Corporation in a novel application of RCRA.
