Biography

 

Mr. Steiger has substantial experience with cases involving real estate development and leasing, construction, supply contracts, antitrust, corporate control, fraud and misrepresentation, vendor, supplier, dealer, distributor and manufacturers representative and franchise terminations, trademark and patent infringement, trade secrets, non-competition covenants, unfair competition, interference with contracts and business relationships, and other business torts, ERISA and employee benefits issues.  He has also defended employment termination and other employment-related civil litigation cases, including all types of discrimination claims, whistleblower and qui tam claims, overtime and other FLSA claims, and disability claims.  Mr. Steiger also has special expertise in cases relating to executive level employees, high-technology and sales industries, and situations involving unfair competition.

Notable Representations

 

Representation of Micron in defense of antitrust and related claims, alleging participation in the price fixing of DRAM memory and a boycott of competing DRAM memory technologies.

 

Representation of Dr. Enrico Bondi, extraordinary commissioner of the new Parmalat, in actions against major lenders and accounting firms, relating to the financing transactions that preceded the financial collapse of Parmalat.

 

Representation of GMAC Commercial Mortgage, a leading commercial mortgage lender and services provider, in a successful defense against attack by a major competitor, alleging improper servicing of commercial loan portfolios.

 

Obtained a large recovery, totaling nearly $30 million, for an NFL football stadium in a highly publicized dispute with an NFL franchise.  The case involved a breach of the lease between the team and the stadium, the intention of the team to move to a new stadium in a nearby city, and complex damages and mitigation issues relating to the unique use and development potential of the stadium property.

 

Lead counsel defending a Fortune 50 national retailer in a major 10b-5 securities fraud case, involving the defense of six consolidated securities fraud class actions brought by most of the major plaintiff firms.  With hundreds of millions of shares traded during the alleged class period, and a per share decline of over $6, the amount at risk was enormous.  As a result of aggressive and effective strategy in trial preparation, the case was ultimately settled for virtually nuisance value.

 

Representation of senior executives in defense of ERISA fiduciary duty claims relating to administration of a Fortune 50 corporation's employee savings plan, the sharp decline in the value of the company's stock, and the effect on the plan assets and investment options.

 

Successful representation of a Fortune 50 corporation in civil and criminal litigation in Puerto Rico, arising out of insurance claims for hurricane losses, and employee misconduct in the preparation of the claims, including the intentional destruction of inventory.

 

On behalf of a Fortune 50 corporation, successfully defended numerous damages and injunction actions brought as a result of the sale of a corporate subsidiary, and the related closure of numerous facilities.  The cases, filed in various jurisdictions around the country, involved claims ranging from alleged violation of continuous operation covenants to alleged violation of bulk sales notice and transfer requirements under various state laws, as well as alleged fraudulent conveyances and other similar claims.

 

Lead counsel for a municipality in a victorious civil RICO and antitrust case, against waste hauling and disposal companies, a major city, and a variety of co-conspirators involved in a price fixing scheme relating to municipal waste disposal; and against the United States to obtain monies taken by the U. S. in criminal forfeiture; multi-million dollar recovery obtained.

 

Trial counsel for an automobile manufacturer in the defense of numerous wrongful discharge and employment discrimination cases.  In addition to obtaining summary judgments, won a no cause verdict in a federal jury trial, subsequently affirmed by the Sixth Circuit.

 

Defended a national retailer in multiple class action litigation in Texas and Colorado, arising out of the stock sale of a subsidiary, and alleged underfunding of the spin-off pension plan.
