As the Academy’s general counsel, we represented it when a German trophy manufacturer made statuettes that looked like OSCAR.  We sued in Berlin and our suit made new law in Germany, with the court holding that the sale of three-dimensional statuettes in the design of an image mark is a trademark use which may indicate the product's origin.  The court enjoined the manufacturer from distributing or advertising its statuettes and assessed damages and attorney's fees.
