American West Homes

We represented American West Homes in a case involving claims of fraud, breach of contract, and breach of guaranty related to the formation of a home development company that lost $20M.  Knowing our claims would best be tried to a judge and not a jury, we convinced the Court to bifurcate the equitable causes of action seeking the dissolution of the company and an accounting of its assets.  In the phase one trial on the equitable causes of action, the Court agreed with every one of our theories why the contracts were enforceable, rejecting every single defense that defendants' raised in an attempt to avoid their obligations. The Court's ruling ensures a judgment for our client in excess of $20M.  In addition, the Court specifically ruled that all of its findings were binding on the future jury phase.
