We represented Avery Dennison in a case brought by the alleged inventor of personalized postage, in which he alleged fraud, negligence and breach of fiduciary duty against both Avery and its regular patent prosecution counsel, Renner Otto. The plaintiff filed suit against Avery and Otto claiming they had intentionally sabotaged his patent application so that Avery would be free to make and sell the invention without paying him royalties. The plaintiff's damages expert estimated lost royalties to be in the neighborhood of $187 million. During discovery, we found a document proving the plaintiff had assigned away his patent application to a partnership he had formed to commercialize the product. We moved to dismiss for lack of subject matter jurisdiction and also moved for sanctions, since the plaintiff had repeatedly denied the existence of the Assignment and had never produced it during discovery. The Magistrate Judge granted our motion to dismiss with prejudice, and awarded attorneys' fees. The District Court then conducted a de novo review and entered judgment in our favor.
