We represented Dr. Curtis Wade as claimant in an arbitration against Nobel Biocare before retired Judge Eugene Lynch (JAMS). The matter involved claims that Nobel breached the terms of a patent licensing agreement by underpayment of royalties over more than five years. In order to prevail, we were required to prove that Nobel's products actually infringed the claims of the licensed patent, the amount of infringing sales, and refute Nobel's defense that the patent was invalid. The matter settled on favorable terms to our client after an evidentiary hearing on patent claim construction. The exact amount of the settlement is confidential.
