We represented Hathaway Dinwiddie Construction and obtained a reversal by the Ninth Circuit of a grant of summary judgment against our client on breach of contract and other claims. We persuaded the Ninth Circuit that the district court had erred by resolving contested contract formation and interpretation issues as a matter of law. The Ninth Circuit affirmed summary judgment in the client's favor on related contract counterclaims.
