We represented RealNetworks, a software company which specializes in file transfer. Ethos sued RealNetworks in United States District Court in Massachusetts for willful infringement of two patents, asserting 10 claims against RealNetworks' products. Ethos sought damages in excess of $200 million, plus punitive damages for willful infringement. We were hired as trial counsel after the close of fact discovery. During the pre-trial phase, we were able to convince the Court to limit the litigation to five products. The judge granted a directed verdict dismissing the willfulness claim. After a five-week trial the jury found that seven of the ten Ethos patent claims were invalid for anticipation and/or obviousness, and found non-infringement as to all 10 asserted claims against each of the RealNetworks accused products. Plaintiff filed a motion for reconsideration and/or a new trial, which was denied. The Federal Circuit later affirmed the verdict.
