We won summary judgment on behalf of The Scotts Company in a billion-dollar antitrust suit brought against it by the largest distributor of herbicides and garden products. After Scotts terminated the distributor and entered a joint venture with Monsanto for the distribution of both companies' products, the distributor alleged that the Scotts/Monsanto Joint Venture was a conspiracy to eliminate the only competition to Scotts in this field. Not only did we win summary judgment on the distributor's claims, but the jury awarded our client $15 million on our counterclaims.
