Our lawyers know how to hone in on the key appellate issues, frame those issues in the most persuasive manner, and argue our clients’ cases simply and forcefully. We combine creative yet disciplined legal reasoning with clear, cogent descriptions of even the most complex facts to show why our clients must prevail. We bring these same skills to bear at the trial level when complex legal issues demand sophisticated briefing and innovative strategies. Our proven track record in reviewing courts also has caused clients to send to us matters that have been litigated in the trial courts by other firms, and to retain us to represent their interests as amici in the appellate courts.
Our appellate practice is headed by Kathleen M. Sullivan, former Dean of Stanford Law School and author of the nation's leading casebook on constitutional law. Ms. Sullivan is one of the most highly regarded appellate lawyers in the country. In 2006 alone, she was recognized by the National Law Journal as one of “The 100 Most Influential Lawyers in America,” by the Daily Journal as one of “The 100 Most Influential Lawyers in California,” and by the Daily Journal as one of "The 75 Top Women Litigators in California." Ms. Sullivan has argued numerous high profile appeals, including winning a case on behalf of California wineries and wine consumers before the United States Supreme Court invalidating state restrictions on the importation of wine from other states. She is also frequently called on for advice on constitutional issues and to consult on or take over arguments in cases on appeal. Ms. Sullivan remains on the faculty of Stanford Law School, where she holds the Stanley Morrison chair.
Many of our lawyers were appellate clerks, and many have substantial appellate experience. Daniel H. Bromberg has been involved in more than two dozen cases in the United States Supreme Court, and he has argued in the Supreme Court and numerous other federal and state courts of appeal. Our lawyers have dozens of appeals before the Second Circuit, Ninth Circuit, and other federal courts of appeal, as well as state appellate courts across the country, and the firm frequently appears before the Federal Circuit in patent cases on behalf of high-tech companies. Our strong bench of former prosecutors, including a former United States Attorney, have argued more than 40 criminal appeals before the federal and state courts of appeal.
