Hedge Fund Litigation

We have extensive experience in the hedge fund litigation arena, including the representation of funds and their investors in pursuing remedies from a variety of parties such as banks, accounting firms, and investment managers.  For example, we represent several major hedge funds that hold complex Enron-related securities in asserting claims against Citibank, which helped to structure the circular payment schemes that were designed to inflate Enron’s revenues and increase quarterly returns.  We have represented many other funds in asserting and defending claims based on similarly complex securities, distressed debt holdings, and other investments.  We have also represented funds and their managers in proceedings before the Securities Exchange Commission and in bankruptcy and bankruptcy-related matters.

On the investor side, our attorneys also have asserted claims on behalf of investor groups in, and trustees and liquidators of, collapsed hedge funds seeking to recover their losses from former investment managers, accountants, and other third-parties involved in actions that led to those funds’ implosions.  In fact, we recently obtained – and sustained in court – a $75 million award against an investment manager following an arbitration spanning seven months.  This may be the highest arbitration award ever against an individual defendant.
