ヨーク・フォークナーは東京オフィスのパートナーとして日本に常駐。トライアルローヤーとして25年の経験を要している。日本語堪能。多数の陪審員裁判や高額訴訟に従事している。

キャリアは米国司法省の税務部門の連邦検察官として始まり、検察官時代には司法妨害、IRS詐欺の陰謀、脱税、税還付請求の虚偽請求、虚偽所得税申告などの刑事裁判また大陪審における犯罪捜査などで手腕を発揮した。

現在、ヨークは様々な業界の知的財産訴訟に重点を置いて活動。新医薬品のメーカーの代理として、製薬特許侵害事件において数々などのブランド医薬品を含む営業秘密、独占禁止、いわゆる「ハッチ・ワックス マン法」の特許侵害訴訟を担当。また、医療機器、自動車部品、半導体設計と製造、鉄鋼製造、商業用ジェットエンジン設計、遺伝子組み換え作物、自動車衝突センサー、デジタル画像処理、虹彩スキャニングおよび識別、液晶ディスプレイ、長距離光ファイバルーティングおよびスイッチング、およびマイクロプロセッサ命令セット等、幅広い分野、連邦裁判所、州裁判所、国際貿易委員会に提訴した事件を担っている。

また、ヨークは首都圏だけでなく、日本国内の複数の都市で弁護士業務に従事した経験を持ち、流暢な日本語には定評がある。日本企業やグローバルなビジネスに影響を及ぼす法的・経済的問題について報告する日本語でのレクチャーを頻繁に実施しているほか、戦略的IP開発、訴訟などについてもアドバイスも好評である。日本の当事者が関与する訴訟において豊富な経験を有しており、日本のクライアントの米国訴訟の負担軽減のため日本国内の専門家集団や弁理士とも連携し、日本企業の米国訴訟負担を軽減するため日夜努めている。

さらに、日本、韓国、中国、オーストラリア、ヨーロッパ、カナダでの係争中の訴訟と米国の訴訟戦略の調整を必要とする複雑なグローバル訴訟を手掛けてきた。こうした経験からヨークはManaging Intellectual Propertyの「IP Stars」と評され、The Legal 500 U.S.からは、営業秘密および著作権訴訟の第一人者と認められている。

Eli Lilly and Co. v. Apotex Inc., et al. – Represented Eli Lilly in multiple ANDA challenges to Orange Book listed patents covering Eli Lilly’s blockbuster Prozac® antidepressant pharmaceutical product.

 

Chiron Corp. v. SmithKline Beecham Corp. – Represented SKB in patent infringement litigation before the U.S. International Trade Commission and Northern District of California regarding SKB’s Engerix® recombinant hepatitis B vaccine product.

 

Connaught Laboratories v. SmithKline Beecham Corp. – Represented SKB in patent litigation before the Middle District of Pennsylvania regarding SKB’s Infanrix® pertussis component vaccine product.

 

Merck v. SmithKline Beecham Corp. – Represented SKB in trade secrets litigation before the Delaware Chancery Court regarding SKB’s Varilrix live attenuated varicella vaccine.

 

GlaxoSmithKline and Shionogi Pharmaceuticals v. Alphapharm et al. – Represented GSK in multiple ANDA challenges to Orange Book listed patents in the Northern District of Illinois, Middle District of North Carolina, and Eastern District of Pennsylvania covering GSK’s blockbuster Paxil® antidepressant pharmaceutical product.

 

AstraZeneca and Shionogi Pharmaceuticals v. Aurobindo et al. – Represented AstraZeneca and Shionogi before the District of Delaware in multiple ANDA challenges to their blockbuster Crestor® anti-cholesterol pharmaceutical product.

 

Shionogi Pharmaceuticals v. Apotex et. al. Represented Shionogi Pharmaceuticals in multiple ANDA challenges to Orange Book listed patents covering Shionogi’s Doribax® pharmaceutical product.
