Dylan Byrd is an associate in Quinn Emanuel’s San Francisco office. A trial attorney trusted by leading companies and innovators, Dylan handles complex, cutting-edge commercial disputes across industries.
Dylan has defended Fortune 100 companies in multi-jurisdictional litigation and guided startups through lawsuits that threatened their survival. Recently, he served as trial counsel for a technology startup following its major acquisition by a public company against a former director who claimed ownership of the startup’s core intellectual property. Dylan examined the plaintiff in court and, after Phase I of trial, secured a complete defense judgment for his clients.
Clients rely on Dylan for his strategic foresight and steady courtroom presence. He is often entrusted with arguing pivotal motions and distilling complex technical issues for the court. He has appeared in courts nationwide and in arbitration on a wide range of cases, such as:
- Intellectual property: trade secret, trademark, copyright, and patent disputes
- Internet law: Communications Decency Act Section 230, the Digital Millenium Copyright Act, the Lanham Act, emerging online torts, and constitutional issues involving free speech, equal protection, due process, and federal preemption
- State-law and commercial claims: breach of contract and the implied covenant, unfair competition, fraud, the Unruh Act, the Fair Employment and Housing Act, tortious interference, defamation, publicity rights, unjust enrichment, replevin, conversion, UCL and deceptive advertising, and products liability
Dylan’s track record spans plaintiff- and defense-side victories across industries, reflecting the versatility that sophisticated clients demand. His recent representative successes include:
- Securing a complete defense judgment for a major online platform, defeating multiple class actions seeking over $1 billion in damages based on claims of defective product design, breach of contract, and discrimination
- Obtaining a permanent injunction and defense judgment for a leading artificial intelligence company in a trademark and unfair competition case involving its core international brand
- Achieving uniform dismissals for a major media company, defeating multi-district telecommunications cases across 13 states
- Winning a precedent-setting Ninth Circuit appeal for a global technology company, obtaining reversal of the district court and dismissal of a class action challenging the client’s “digital billboard” web browser overlays
- Securing a favorable settlement for a leading online gaming platform in a defamation case
- Prevailing on behalf of a major online platform against copyright infringement claims brought by an international film distributor challenging the platform’s hosting and display of its works
Dylan is committed to pro bono service and has secured complete victories in immigration court, landlord-tenant disputes, and a variety of constitutional issues. He also counsels companies on litigation risk and regulatory issues involving artificial intelligence, data systems, data privacy, force majeure, and internet law.
