Carl Spilly is Of Counsel in Quinn Emanuel’s Washington, D.C. office. Since joining the firm in 2016, his practice has focused on high-stakes Section 337 investigations before the International Trade Commission (ITC), antitrust litigation and investigations, and data privacy class actions.

Carl has extensive stand-up experience in complex litigation matters. He has served as a core member of multiple trial teams, preparing and defending witnesses for some of the world's most recognizable technology and consumer brands and conducting cross-examinations of opposing parties’ expert witnesses and senior executives. His practice also encompasses representing corporate clients in sensitive internal investigations and regulatory matters.

  • Obtained a limited exclusion order for JUUL Labs Inc. in a Section 337 investigation before the International Trade Commission (ITC) against NJOY and Altria, successfully barring the importation of infringing vaporizer devices and cartridges.
  • Successfully defeated class certification on behalf of Google in Calhoun et al. v. Google LLC, a high-profile data privacy class action in which the plaintiffs sought to recover billions of dollars on behalf of all U.S.-resident Chrome users on the basis of Google’s alleged misappropriation of Chrome users’ personal information through its third-party web services such as Ad Manager, Analytics, Embedded Maps, Fonts, and other services. The complaint asserted sixteen causes of action, including federal and state wiretapping claims, breach of contract, unfair competition, and state law constitutional and common law privacy claims.
  • Obtained, on behalf of IBM and The Weather Company (TWC), complete stipulated dismissal of a putative class action in the U.S. District Court for the Northern District of Florida alleging that TWC’s collection of geolocation data violated Florida’s Deceptive and Unfair Trade Practices Act.
  • Obtained, on behalf of IBM and TWC, a settlement with no fine and no admission of wrongdoing in an action brought by the Los Angeles City Attorney on behalf of the People of California in California state court alleging that TWC’s purported failure to disclose its use and sharing of users’ geolocation data for advertising and other commercial purposes violated California’s Unfair Competition Law.
