Court Upholds Trial Victory for Voxer against Facebook

Quinn Emanuel defeated Facebook’s post-trial motions securing a jury verdict in the Western District of Texas that awarded $174.5 million in running royalties to our client Voxer. The weeklong trial ended in an infringement verdict finding that Facebook and Instagram Live used two Voxer patents related to Voxer’s Live Messaging — technology that had its genesis during Tom Katis’ deployment as a special forces communications sergeant in Afghanistan for the U.S. army after the 9/11 attacks.

At trial, the QE team, led by Robert Stone, Mike Powell, and Sam Stake, detailed Voxer’s lengthy, troubled history with Facebook before Facebook launched its own infringing live-messaging services. After just 2.5 hours of deliberations, the jury found all six asserted claims across the two patents infringed, affirmed patent validity, and awarded running royalties in addition to the damages award. In addition to denying Facebook’s post-trial motions, Judge Yeakel granted an additional $29 million in pre-judgment interest.
