One of President Trump’s earliest executive orders in his second term declared a national energy emergency due to, among other things, an “increasingly unreliable grid.” Officials from both political parties have recognized this problem, while differing in how to solve it. In this article, Quinn Emanuel partner Sanford I. (“Sandy”) Weisburst and associate Linda Moon summarize the early executive order and several follow-up orders, explaining how they have ordered expedited environmental reviews for certain new projects and temporarily exempted from environmental laws existing resources that were to shut down but were deemed essential to continue operating. The latter approach is authorized by Section 202(c) of the Federal Power Act but historically has been invoked for shorter time periods. Now, it is being invoked for longer periods to address issues of grid reliability and resource adequacy.
