Major appellate win! Quinn Emanuel, alongside WilmerHale, was recognized in ALM | Law.com’s Litigator of the Week series for achieving a landmark victory for Citadel Securities and other financial firms in a $1.6 billion Mallinckrodt stock buyback clawback dispute.

Judge Stephanos Bibas of the Third Circuit, sitting by designation in the District of Delaware, affirmed critical safe harbor protections under Bankruptcy Code Section 546(e), rejecting the opioid trust’s novel theory that would have allowed foreign corporate law violations to void otherwise-protected securities transactions—a ruling with significant implications for market stability and the finality of securities transactions.
