Quinn Emanuel has once again been named in the Daily Journal’s Top Verdicts of 2025, which recognizes California’s top verdicts by dollar, impact, defense victories, and appellate reversals, for securing a complete summary judgment for OpenAI against Open Artificial Intelligence, Inc.
The case: The dispute centered on a clash over senior rights. Guy Ravine, founder of Open Artificial Intelligence, Inc. claimed to own a trademark for "Open AI" since 2015. However, Ravine’s initial trademark application was rejected by the USPTO in March 2016, as his website failed to show actual use in commerce. While Ravine was able to obtain a registration on the USPTO’s Supplemental Register in 2017, the Quinn Emanuel team found evidence proving Ravine’s pivotal specimen was a fabrication. In 2022, Ravine and Open Artificial Intelligence, Inc. attempted to launch several products under the name “Open AI” and “open.ai.”
The verdict: Judge Yvonne Gonzalez Rogers ruled that our client’s “OpenAI” mark had acquired secondary meaning, giving it senior trademark rights, which Defendants infringed. The Court granted permanent injunctive relief against Open Artificial Intelligence, Inc.
