Quinn Emanuel was recognized in ALM | Law.com's Litigator of the Week series, earning a Runners-Up recognition for our Optilogic victory and a shout-out for securing dismissal of securities claims against Tesla.

🏆 Major win for supply chain innovation: Partners Todd Anten, Brianne Straka, Kimberly Carson, and Mike Barlow secured a critical victory for Optilogic Inc. against industry giants Coupa Software and LLamasoft in Delaware federal court. U.S. District Judge Richard Andrews denied a preliminary injunction that would have effectively shuttered the startup, finding that "when you have a company that only has one product and you're basically enjoining the product, that the company is going to fold." The ruling allows Optilogic to continue operating its supply chain management software and servicing clients. At the end of an evidentiary preliminary injunction hearing, Judge Andrews reasoned that “I don't think there's much significant likelihood of success” on Plaintiffs’ trade secret and copyright claims, “plaintiff hasn't shown any irreparable harm” due to their delay in seeking relief, and the balance of hardships favored Defendants. A pivotal decision protecting competitive market entry and entrepreneurial innovation in the software industry.

Ninth Circuit Tesla victory: Partners Ellyde Thompson and Jesse Bernstein, alongside Associate Leigha Empson, secured a ruling from the Ninth Circuit upholding the dismissal of a securities suit accusing Tesla and Elon Musk of misrepresenting the safety and capability of Tesla's autonomous driving technology from 2019 to 2023. The appellate court held that the company consistently stated the technology required a "fully attentive driver" and that Musk did not claim the technology was safer than humans, but rather that a driver with the technology is safer than a driver without it.
