Quinn Emanuel's team, led by Jesse Bernstein, John Bash, and John Quinn, obtained a rare grant of a motion for reconsideration, resulting in the grant of Defendants’ motion to dismiss. The case, filed in the Western District of Texas, alleges that officers and directors of Core Scientific, Inc. made material misrepresentations in connection with Core’s de-SPAC transaction. The Court granted Defendants’ motion to dismiss with respect to all but a single alleged misstatement. Quinn Emanuel filed a motion for reconsideration regarding the sole surviving statement, arguing that the theory of falsity endorsed by the Court was not pled by Plaintiffs and was not viable as a matter of law, which the Court granted.
