Quinn Emanuel Secured a Complete Summary Judgment for OpenAI against Open Artificial Intelligence Inc.

We're pleased to announce that a Quinn Emanuel team led by Margret Caruso and Robert Feldman secured a complete summary judgment for OpenAI against Open Artificial Intelligence Inc. in N.D. Cal.

The dispute? Guy Ravine claimed to own a trademark for "Open AI" since 2015 (before OpenAI existed) but launched a competing image generator in 2022 on opena.ai. Judge Yvonne Gonzalez Rogers ruled that our client’s “OpenAI” mark had acquired secondary meaning by then, giving it senior trademark rights, which Defendants infringed.

The case highlights that domain ownership alone doesn't create trademark protection, especially when another company develops strong market recognition in space the domain holder later tries to enter.
