Following a hard-fought evidentiary preliminary injunction hearing last August, U.S. District Judge Richard Andrews issued a written order denying Plaintiffs' motion for preliminary injunction – a ruling that would have effectively shuttered the startup. The written decision expands on Judge Andrews' rationale for denying relief in this trade secret and copyright case.
In his decision, Judge Andrews concluded that Plaintiffs failed to meet their burden on multiple grounds:
➡️"I don't think there's much significant likelihood of success" on the trade secret and copyright claims
➡️"Plaintiff hasn't shown any irreparable harm" due to their delay in seeking relief
➡️The balance of hardships favored Defendants
The ruling ensures Optilogic can continue serving its clients and growing its business without the threat of a company-ending preliminary injunction hanging over its operations.
