Today, Mrs Justice Joanna Smith DBE dismissed all claims brought by Richard Desmond's Northern & Shell against the Gambling Commission challenging its award to Allwyn of the 4th UK National Lottery Licence and its subsequent modification. The Judge found that Northern & Shell had been properly disqualified from the Competition, that there was an "enormous gap" of over 30% in scores between its bid and Allwyn's, and that its £1.3 billion damages claim was "fanciful" - TNLC had stood no real chance of winning against Allwyn, described by the Judge as "a global leader in the lottery industry," if not "the world leader in conducting lotteries." The 4th Licence was fairly and properly awarded to Allwyn and had been lawfully modified by the Commission.
Following victories against Camelot and IGT, today's judgment brings four years of litigation to a close.
