Eric Kay practices in the firm’s Bankruptcy and Restructuring Group. He has extensive experience in all areas of corporate and municipal restructurings, both in the context of large, complex Chapter 9 and Chapter 11 cases and out-of-court restructurings. He regularly represents debtors, official and unofficial creditors’ committees, secured lenders, distressed debt investors, acquirers and other creditors in numerous bankruptcy proceedings in the United States. Recently, Eric was one of the Firm’s lead attorneys representing the COFINA Senior Bondholder Coalition, the largest organized group of creditors of Puerto Rico, in its successful restructuring under Title III of the Puerto Rico Oversight, Management, and Economic Stability Act (PROMESA), the very first use of the statute that Congress passed in 2016 to address the Puerto Rico financial crisis. Eric started his professional career as a law clerk for the Honorable Stuart M. Bernstein in the United States Bankruptcy Court for the Southern District of New York.

- Bernard L. Madoff Investment Securities LLC – Represented multiple defendants in clawback litigation arising out of the Madoff Ponzi scheme
- Lehman Brothers Holdings, Inc. – Represented Official Creditors Committee.
- RadioShack Corporation – Represented Official Creditors Committee.
- Jefferson County, Alabama – Represented major creditor in Chapter 9 bankruptcy.
- SemGroup LP – Represented Official Creditors Committee.
- The Brooklyn Hospital Center – Represented Debtor-in-Possession.
- Global Power Equipment Group – Represented a group of equity holders in effectuating a successful rights offering.
- Centro Properties Group – Represented a group of lenders in an out-of-court restructuring.
- Formica Corporation – Represented Official Creditors Committee.
- National Energy & Gas Transmission, Inc. – Represented successful purchaser of assets in bankruptcy case of NEGT.
- Recoton Corporation – Represented Debtor-in-Possession.
- TransTexas Gas Corporation – Represented Debtor-in-Possession.
- Worldtex, Inc. – Represented Official Creditors Committee.
