- Trial counsel to IBM at a six-week trial involving claims of breach of contract and fraud. The trial court rejected the other side’s billion-dollar damages claim and awarded IBM over $40 million.
- Trial counsel to Navistar at a two-week jury trial involving claims of breach of contract, breach of warranty, and fraud. The jury found in Navistar’s favor.
- Trial counsel to an aerospace company at a week-long jury trial involving a breach of contract claim. The jury found in our client’s favor.
- Trial counsel to a property developer in an expedited arbitration involving the sale of a commercial property portfolio. The arbitrator found in our client’s favor and awarded attorneys’ fees to our client.
- Trial counsel to healthcare business in week-long arbitration involving claims of breach of fiduciary duty. The panel found in our client’s favor on the fiduciary duty claims.
- Trial counsel to former CEO of healthcare business in dispute involving claims of breach of contract and breach of fiduciary duty. Matter resolved after the court rejected our opponent’s attempt to secure a preliminary injunction restricting our client’s business dealings.
- Trial counsel to State Mutual Insurance Company in claims involving alleged unfair business practices. Matter resolved after our opponent failed to secure a preliminary injunction restricting our client’s sales.
- Trial counsel to Life Spine, a medical device manufacturer, in a nine-day preliminary injunction hearing regarding a dispute with Life Spine’s former distributor involving claims of trade secret theft, breach of contract, and breach of fiduciary duty. Matter ongoing.
- Trial counsel to minority shareholder seeking to appoint a receiver over a business that owns and operates several hotels. Matter ongoing.
- Litigation counsel to Navistar in a breach of contract case filed by Ford Motor Company, where Ford sought over $1 billion in damages. After two years of litigation, the parties entered into a confidential settlement agreement. In a joint press release, the parties stated that as part of the settlement, Ford made a cash payment to Navistar, and Navistar also acquired additional equity in certain joint ventures between the companies.
- Litigation counsel to Boeing in a nine-figure contract dispute. Boeing was awarded over $500 million on summary judgment and subsequently prevailed against U.S. affiliates of the foreign defendant on an alter ego theory.
- Litigation counsel to Edison Mission Energy in investigation of claims against EME’s former parent company. The Chapter 11 plan incorporated a global settlement of all claims and disputes with EME’s former parent, resulting in approximately $1 billion in additional value for EME’s estates.
- Litigation counsel to Winston & Strawn in a $1.6 billion legal malpractice case. Secured dismissal of plaintiff’s complaint with prejudice; the Seventh Circuit affirmed.
- Litigation counsel to Motorola in purported nationwide class actions based on an alleged risk of hearing loss from use of wireless headsets.
- Litigation counsel to Platinum Supplemental Insurance in purported class action involving claims of alleged unfair business practices.
- Litigation counsel to Motorola in a series of cases alleging that radiofrequency energy from wireless phones causes personal injuries.
- Litigation counsel in multiple confidential post-closing purchase price disputes, each of which resulted in a price adjustments in client’s favor.
- Advisory counsel in multiple confidential investigations involving insider trading, allegations of executive misconduct, and other matters.
