Quinn Emanuel Urquhart & Sullivan partners Rob Zink and Avi Perry, along with co-counsel Craig Carpenito of King & Spalding, have been honoured as AmLaw's "Litigators of the Week" following their exceptional victory in a high-stakes case against the Commodity Futures Trading Commission (CFTC).
The team secured case-ending sanctions against the CFTC in their enforcement action against Traders Global Group Inc. and its founder Murtuza Kazmi, which operated the simulated trading platform "My Forex Funds". The case involved serious allegations of misconduct by CFTC enforcement staff, who misrepresented $31.5 million CAD in transfers as being sent to "an unidentified Kazmi account" when the funds were actually payments to Canadian tax authorities.
U.S. District Judge Edward S. Kiel of the District of New Jersey adopted the report of Special Master, retired U.S. District Judge Jose Linares, who found the CFTC "acted willfully and in bad faith on several occasions" and chose "a path of obfuscation and avoidance" rather than correcting the record.
The Quinn Emanuel team also included partner Kurt Wolfe and associates Dakota Speas and Matt Feibert, working in close partnership with the King & Spalding team of Craig Carpenito, TJ Scrivo, Alex Kazam, Paige Tenkhoff and Jeff Bucholtz.
