Quinn Emanuel team secures a victory in the Delaware Supreme Court for Special Litigation Committee

Quinn Emanuel is pleased to report the successful conclusion of its representation of a Special Litigation Committee (SLC) of the Baker Hughes Board after the Delaware Supreme Court affirmed last week a Court of Chancery order dismissing a derivative suit against GE and certain Baker Hughes Directors. Addressing for the first time the propriety and treatment of live testimony at a hearing on an SLC’s motion to terminate derivative litigation, the Delaware Supreme Court concluded that the Court of Chancery properly relied on its assessment of a live witness’s credibility in deciding to dismiss the case. Houston Partner Karl Stern and Of Counsel Liz Devaney represented the SLC in its nine-month investigation of the derivative claims and in the court proceedings on the SLC’s motion to terminate, along with co-counsel Tom Bayliss and Matt Miller with Abrams & Bayliss in Delaware.
