Quinn Emanuel Wins Dismissal of Colorado Case Against IVF Test Provider

Quinn Emanuel won a decisive court order last week in its defense of a company that sells tests to people going through in vitro fertilization, against plaintiffs who claimed that our client made false and misleading statements about the products’ effectiveness.

U.S. District Judge S. Kato Crews in Denver granted our motion to dismiss the case, Tyman v. CCRM Parent Holdings, Inc., finding the plaintiffs failed to allege that the PGT-A testing they purchased was inaccurate or didn’t meet the applicable standard of care, and that they therefore lacked Article III standing.

The dismissal comes as more lawsuits are being filed against providers of IVF care and products over tests that plaintiffs claim affected their decision processes or outcomes.
