Quinn Emanuel is pleased to announce a significant victory for our clients Arranta Bio and Recipharm AB against ThermoFisher Scientific in Delaware Chancery Court following an expedited trial before VC Cook.
In April 2022, Thermo opportunistically terminated the parties’ deal and announced falsely to the market that Arranta was out of the plasmid business—just as Thermo “coincidentally” got its own plasmid operation up and running. They claim they were entitled to terminate the parties’ exclusive joint venture and force Arranta into a three-year non-compete that would have effectively put Arranta out of the plasmid business. This claim has been rejected in its entirety.
