Asher B. Griffin is Co-Managing Partner of Quinn Emanuel’s Austin, Texas office. Asher is a true generalist who handles complex and bet-the-company litigation across myriad industries, representing both defendants and plaintiffs.  Asher's docket regularly includes all types of business disputes, including breach of contract, non-competition, breach of fiduciary duty, fraud, usurpation of corporate opportunity and trade secret cases.  Many of his cases involve private equity funds, hedge funds, and their portfolio companies.  Practicing in Texas has given Asher the opportunity to handle many oil and gas disputes, including reservoir valuation issues, lease disputes, royalty fights, right of first refusal disputes, and midstream disputes.  In addition, Asher has spent more than a decade representing manufacturers in various types of product liability cases, with a particular focus on pharmaceutical and device litigation, including taking a key role in mapping out and executing the defense strategy as lead Manufacturers’ Liaison Counsel in the Texas Opioid Multi-District Litigation.  He has also represented some of the world’s largest technology companies in patent infringement actions.  Asher has prosecuted and defended lawsuits throughout Texas and around the country, in both state and federal courts.

  • Acted as the Lead Manufacturer Defendants’ Liaison Counsel in the Texas Opioid MDL.
  • Represented Johnson & Johnson and Janssen in product liability litigation involving antipsychotics.  Secured numerous voluntary dismissals after showing that plaintiffs’ claims had no merit.
  • Represented Johnson & Johnson and Janssen in defense of Medicaid fraud lawsuit brought by the State of Texas related to antipsychotics.  Secured favorable settlement during trial at a small fraction (less than 1/10) of the alleged damages/penalties.
  • Represented AstraZeneca in defense of Medicaid fraud lawsuit brought by the State of Texas related to antipsychotics.  Secured favorable settlement.
  • Represented Johnson & Johnson and Janssen in defense of Medicaid fraud lawsuit brought by the State of Texas related to opioid pain relievers.
  • Confidential Client - Represented hedge fund in partnership and valuation lawsuit brought by disgruntled investor.  Secured a confidential settlement for less than defense costs.
  • Confidential Client - Brought in by private equity fund to represent a portfolio company on the eve of a state court trial in Mobile, Alabama.  Secured a favorable settlement after prevailing on numerous evidentiary motions during pre-trial.
  • Represented equity tranche buyer of RMBS backed CDO in plaintiffs’ side lawsuit against Morgan Stanley in New York State Court related to the 2008 financial crisis.  Secured confidential settlement after being the first equity tranche buyer to survive a motion to dismiss.
  • Represented Petroplex Energy in a trial against Smith International related to the blowout of a sour gas well in West Texas.  Secured favorable confidential settlement during the second week of trial.
  • Represented West Telecommunications in defending against several FLSA collective actions related to employee classifications.  Several cases involved more than 10,000 plaintiffs.  Cases filed in federal courts across the county from E.D. Washington, to the District of Nebraska, to the N.D. of Georgia.  Defeated collective action certification in several matters and secured favorable settlements in others.
