Dylan examines the complex and evolving legal landscape surrounding copyright infringement claims for architectural floor plans.  Home builders are suing real estate agents over alleged unauthorized floor plan use, and courts have reached different results about whether floor plans fall under the Copyright Act Section 120(a). The Eighth Circuit ruled earlier this year that real estate agents’ use of floor plans can constitute fair use, but that decision may soon be appealed to the Supreme Court.
