Trials, Arbitrations, and Evidentiary Matters

  • Defended technology company in a bench trial brought by investors in the company, securing a complete defense verdict on claims for Section 10(b) securities fraud, common law fraud, and breach of contract. The Court also awarded defendants all attorney’s fees and costs associated with defending the action.
  • Represented plaintiff in a bench trial involving a complex LLC management dispute, obtaining award permitting client to participate in the management of a multi-billion dollar real estate empire. 
  • Obtained nine-figure arbitration award for professional sports team in breach of contract action related to fees owed to it by a broadcasting station.
  • Represented real estate developer in a bench trial against the City of Oakland, prevailing on breach of contract claims and invalidating a local ordinance that had restricted the developer’s activities.
  • Defended technology company in a dispute with former employee over wrongful termination and commission payments, securing a complete defense verdict following jury trial.
  • Represented departed founders of a venture capital firm in a confidential arbitration regarding their right to returns from the fund.
  • Obtained arbitration award for technology company in breach of contract action against reseller for improper “gray marketing” of the company’s product, while also defeating counterclaims asserted by the reseller.

  • Represented venture capital firm in a securities case against portfolio company for fraudulent inducement related to DNA sequencing technology investment, with litigation leading to the defendant’s bankruptcy.
  • Obtained settlement for media conglomerate one day before jury trial, and following favorable summary judgment ruling, in a dispute over the valuation of a privately-held company.
  • Defeated fraudulent inducement and federal securities fraud claims on motion to dismiss based on anti-reliance language in an investment agreement.
  • Represented investor in a securities fraud suit against a real estate investment fund, securing the return of all invested funds.
  • Obtained favorable settlement on behalf of software company on eve of preliminary injunction hearing that threatened to halt marketing of its core product in trade secret dispute.
  • Defended DNA sequencing company in a bet-the-company trade secret litigation, obtaining favorable settlement pre-trial while dispositive motions were pending.
  • Successfully defended technology company in software implementation dispute, resulting in plaintiff dropping all claims while dismissal motion was pending.
